DACA Reinstated by Federal Judge



In Brooklyn, Judge Nicholas Garaufis ordered the DHS (Department of Homeland Security) to notify the public on its website that it will be accepting new applicants to the DACA program. This will be the first time since 2017 that new applicants will be considered and accepted to the DACA program.

A Brief History of DACA


The DACA program was created during the Obama administration in 2012 to allow individuals to put off deportation for two-year increments. In 2016, Trump and his administration made clear their intention to rescind DACA. Trump claimed that DACA and the DREAM act were “executive amnesties in which he defied federal law and the Constitution”. Though for a time in 2016 Trump seemed to sway his opinion on DACA, he followed through on his original promise to rescind DACA in 2017.


Only a year later in 2018 did a judge order the Trump administration to renew DACA, which briefly seemed like a possibility. After one of the President’s Twitter tirades, he fell back to his old ways seemingly over a personal feud with Senator Dicky Durbin who Trump claimed, “Totally misrepresented what was said at the DACA meeting.”



Now, in December 2020, as we’re in the middle of the COVID-19 epidemic and nearing the end of the first and final Trump term Judge Nicholas Garaufis has ordered the DHS to prominently display on there, and all other relevant, website(s) that they are “accepting first-time requests for consideration of deferred action under DACA, renewal request, and advance parole requests based on the terms of the DACA program prior to September 5th, 2017”.
